Justice William Atuguba, a former justice of the Supreme Court, called the court’s ruling in the Gyakye Quayson case revolting.
Justice Atuguba stated in a lecture on Tuesday, October 24, 2024, that it is against fundamental legal principles for the supreme court to have made an adjudication on a case that the High Court had previously ruled.
He said that rather than starting a new case in the Supreme Court, the High Court’s ruling should have been implemented.
“The decision of the Gyakye Quayson case was scandalous. The Supreme Court re-adjudicated the matter already decided by the High Court,“ he said during his presentation which was monitored by 1Family Radio.
Justice Atuguba reiterated that the Supreme Court had not done justice when it declared Mr. Quayson’s election invalid in December 2020, despite the fact that the MP had explicitly renounced his Canadian citizenship in November 2020.
“The Supreme Court does not stand in good light despite the clear renunciation in November 2020 whereas the election was in December, I am not able to see substantial justice in this,” he noted.
In his view, the Supreme Court’s conclusion that Mr. Quayson had allegiance to Canada was unreasonable given that he had formally renounced his Canadian citizenship in 2019.
